Preamble
These General Terms and Conditions of Sale (hereinafter “GTC”) govern all orders placed on the website www.huitieme-ciel.com (hereinafter the “Site”) and the sale of jewelry and accessories (hereinafter the “Products”). By placing an order on the Site, the customer (hereinafter the “Customer”) unreservedly accepts these GTC, to the exclusion of all other terms.
Article 1 – Scope of Application
1.1 These GTC apply to any order of Products placed by a consumer, a natural person acting for purposes outside the scope of their professional activity.
1.2 The GTC, together with the order summary, constitute the sole contract applicable between the Customer and HUITIÈME CIEL for the purchase of Products on the Site.
1.3 HUITIÈME CIEL reserves the right to modify the GTC at any time. The applicable GTC are those in force on the day the order is validated by the Customer.

Article 3 – Products and Descriptions
3.1 The Products offered for sale are described on the Site with their essential characteristics (materials, stones, dimensions, indicative weight, etc.) and illustrated by photographs.
3.2 Despite the care taken, slight differences in shade, appearance, or dimension may exist between the photographs and the delivered Product, particularly due to natural stones, lighting, and screen settings. These variations do not constitute a lack of conformity.
3.3 Products remain the property of HUITIÈME CIEL until full payment of the price by the Customer.
3.4 HUITIÈME CIEL reserves the right to withdraw or modify a Product offered for sale at any time, without affecting orders already validated.
Article 4 – Price and Payment
4.1 Prices are indicated in Euros, all taxes included (TTC). VAT is not applicable under article 293 B of the CGI.
4.2 Delivery costs are calculated based on the destination, delivery method, and package weight. They are indicated to the Customer before final validation of the order.
4.3 HUITIÈME CIEL may modify its prices at any time, but Products are invoiced based on the rate in force at the time of order validation.
4.4 Payment for the order is due immediately and is made by the means offered on the Site (Credit card, PayPal, etc.).
4.5 Payments are secured via specialized providers complying with current security standards.
4.6 The order is considered final after payment confirmation by the banking institution. A confirmation email is then sent to the Customer.
Article 5 – Orders, Delivery, and Receipt
5.1 Order Process
Orders are placed online via the Site’s shopping cart. The Customer must:
- select Products and add them to the cart
- check the order summary
- enter their contact details and delivery address
- choose the available delivery method
- accept these GTC
- proceed to payment.
Final validation constitutes full and complete acceptance of the GTC.
5.2 Order Confirmation
Once payment is validated, a confirmation email summarizing the order (Products, price, shipping costs, delivery address) is sent to the address provided by the Customer.
5.3 Delivery Zones
HUITIÈME CIEL delivers to over 100 countries worldwide.
Specific delivery conditions (times, shipping costs) are automatically displayed after entering the delivery address during the order process.
Before validating the order, the Customer must verify that their destination is among the zones offered when entering the address.
5.4 Delivery Times
The indicative delivery times after order processing are as follows:
- Metropolitan France, Corsica, Andorra, Monaco: 2 to 4 business days
- Europe: 3 to 7 business days
- DOM/ROM: 5 to 14 business days
- Rest of the world: 5 to 21 business days
These times do not include order preparation time. Delays may occur in exceptional circumstances beyond the control of the Seller and the carrier (bad weather, strikes, seasonal overload, health crises, etc.).
5.5 Transport and Responsibility
HUITIÈME CIEL chooses the appropriate carrier. Once the package is handed over to the carrier, the Seller’s responsibility is limited to faults directly attributable to them (preparation, labeling). The carrier assumes responsibility for routing and delivery.
5.6 Verification upon Receipt
The Customer must check the condition of the package and Products upon receipt:
- open or damaged package
- missing, broken, or non-compliant Products
- severely damaged packaging.
Any anomaly must be reported to the Seller within a maximum of 48 hours after receipt, with supporting photos. After this period, no claim related to transport will be considered.
In case of anomaly, the Customer must:
- contact HUITIÈME CIEL by email at contact@huitieme-ciel.com within 48 hours
- provide photos of the package and the Product
- keep the package and packaging
- indicate the order number and tracking number.
The Seller will propose, after analysis, an appropriate solution (replacement, refund, return…).
5.7 Customs and International Deliveries
For deliveries outside the European Union or in certain specific areas:
- customs duties, import taxes, customs clearance fees, and administrative fees are entirely the responsibility of the Customer
- the Seller never pays these fees for the Customer
- the Customer must inquire beforehand about the regulations of their country.
In case of refusal to pay these fees or customs blockage, the package may be returned to the Seller. The Customer may then request:
- either a refund for undelivered Products, less initial shipping costs.
- or a reshipment (shipping costs at their expense)
Article 6 – Right of Withdrawal
The applicable legal framework is that of articles L221-18 et seq. of the Consumer Code.
6.1 The Customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without justification or penalty, except for the exceptions provided below.
6.2 Exceptions: in accordance with article L221-28, the right of withdrawal does not apply to:
- personalized or custom-made jewelry (engraving, specific creation, adaptation to request, etc.)
- Products that have been worn, used, modified, or damaged by the Customer
- Products clearly presented as “clearance,” “end of collection,” or similar, when specified.
6.3 To exercise the right of withdrawal, the Customer must inform the Seller via:

6.4 Return Conditions: the Product must be:
- unworn
- unmodified
- undamaged
- returned in its original packaging
- accompanied by the invoice or a copy.
Any Product not meeting these criteria may be refused and returned to the Customer, without refund.
6.5 Return shipping costs are entirely the responsibility of the Customer.
6.6 Refunds will be processed within a maximum of 14 days after receipt and inspection of the returned Product, using the same payment method as used for the order, unless otherwise agreed.
Article 7 – Legal Guarantees
7.1 Legal Guarantee of Conformity
In accordance with articles L217-3 to L217-17 of the Consumer Code, the Customer benefits from the legal guarantee of conformity for any lack of conformity existing at the time of delivery of the Product and which appears within a period of 2 years from the delivery of the Product.
If a lack of conformity appears within 2 years after receipt of the jewelry, it is presumed to have existed since delivery, unless proven otherwise by the Seller.
The Customer can choose to obtain:
- repair of the Product
- replacement of the Product
- failing that, a price reduction or cancellation of the sale (refund).
The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
7.2 Legal Guarantee against Hidden Defects
In accordance with articles 1641 to 1649 of the Civil Code, the Customer may also invoke the guarantee against hidden defects and, in this case, choose between cancellation of the sale (refund) or a price reduction. The action must be brought within 2 years from the discovery of the defect.
7.3 Exclusions from Guarantee
These legal guarantees do not cover defects resulting from:
- normal wear and tear
- lack of maintenance
- abnormal or non-compliant use
- impact, fall, or exposure to chemicals or abrasives
- modification or repair carried out by an unauthorized third party
- non-compliance with the provided care instructions.
7.4 Reference Legal Texts
Article L217-3 of the Consumer Code: “The seller delivers goods in conformity with the contract and with the criteria set out in article L. 217-5. They are liable for any lack of conformity existing at the time of delivery of the goods within the meaning of article L. 216-1, which appears within two years from that date.”
Article L217-4 of the Consumer Code: “The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was their responsibility under the contract or was carried out under their responsibility.”
Article L217-12 of the Consumer Code: “The action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.”
Article 1641 of the Civil Code: “The seller is bound by the guarantee against hidden defects of the sold item which render it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given only a lower price for it, had they known of them.”
Article 8 – After-Sales Service and Repairs
8.1 Principle
The Seller offers:
- after-sales service under legal guarantee (see Article 7)
- paid after-sales service (maintenance, out-of-warranty repair, restoration, etc.).
8.2 Contact
All after-sales service requests, whether under legal guarantee or out of warranty, are made via:
- the dedicated form on the Site’s Care and Repair page
- or by email to contact@huitieme-ciel.com.
8.3 Information to Provide
The Customer must provide:
- the purchase date and order number.
- the invoice or proof of purchase
- a precise description of the problem
- clear photos of the jewelry and the defect
8.4 Aater-sales service under Legal Guarantee (Free)
When the observed defect falls under the legal guarantee of conformity (Article 7), after analysis of the file and receipt of the jewelry, the Seller may propose, as appropriate:
- free repair
- replacement with an equivalent piece of jewelry
- price reduction
- or full refund of the Product.
The repair time under guarantee is communicated after receipt and full inspection of the jewelry at the workshop. It depends on the nature of the work, the necessary parts, and the volume of requests.
If the announced repair time exceeds 30 days or is not met, the Customer may request a price reduction or cancellation of the sale in accordance with articles L217-9 and L217-10 of the Consumer Code.
The outbound shipping costs for a return under legal guarantee are the responsibility of the Customer.
Return shipping costs after repair or replacement are covered by the Seller.
8.5 Out-of-Warranty after-sales service (Paid)
For any out-of-warranty intervention (refurbishment, cleaning, stone or clasp replacement, modification, restoration, etc.), a free personalized quote is offered after receiving information and photos of the jewelry.
The quote specifies:
- the nature of the intervention
- the cost of labor, parts, and materials
- the estimated time
- return shipping costs.
The Customer has 30 days to accept or refuse the quote. Without a response within this period, the quote is considered refused.
8.6 Shipping Costs
Outbound and return shipping costs for paid after-sales service are the responsibility of the Customer, unless otherwise stated in the accepted quote.
8.7 Guarantee on Paid Repairs
Paid repairs benefit from a 6-month guarantee on the work performed (replaced parts and labor), excluding new normal wear and tear, misuse, or subsequent intervention by a third party.
8.8 Care Instructions
Detailed care instructions are provided on the Site’s Care and Repair page and in the documentation accompanying each order, to extend the lifespan of the jewelry and prevent avoidable damage.
Article 9 – Liability
The Seller’s liability is limited to the amount of the order concerned. The Seller cannot be held responsible for:
- indirect or immaterial damages
- damages resulting from improper use of the Product
- delays or impossibilities of delivery attributable to the carrier, customs, or a case of force majeure.
Article 10 – Personal Data Protection
Personal data is processed in accordance with the privacy policy available on the Website (purposes, retention period, rights of access, rectification, erasure, opposition, etc.). The Client has rights of access, rectification, and erasure (Art. 15-22 GDPR).
Article 11 – Intellectual Property
All elements of the Website (texts, photos, logos, creations, models, brand name) are protected by intellectual property law. Any unauthorized reproduction or use is prohibited.
Article 12 – Applicable Provisions
12.1 These General Terms and Conditions of Sale are subject to French law.
12.2 In the event of a dispute, an amicable solution will be sought first. Failing this, the courts of Strasbourg shall have jurisdiction.
12.3 The fact that the Seller or the Client does not invoke a clause of the General Terms and Conditions of Sale does not imply a waiver of the right to invoke it later.
12.4 Force Majeure
In the event of force majeure (strike, pandemic, logistical problem, natural disaster, transport blockade, administrative decision, war, attack, or any external event that is unforeseeable and irresistible within the meaning of French jurisprudence), the Seller’s obligations are automatically suspended for the duration of the event, without any possible compensation for the Client.
If the force majeure event extends beyond 60 days, either party may request the cancellation of the current order by simple written notification, without compensation from either side, excluding reimbursement for undelivered Products already paid for.

Email exchanges with contact@huitieme-ciel.com constitute proof. Orders and payments are archived for 10 years.
Article 15 – Consumer Mediation
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, the Client has the right to use the mediation service offered by HUITIÈME CIEL free of charge.
In the event of a dispute, the Client must first attempt to resolve the disagreement directly with HUITIÈME CIEL.
If no amicable solution is found within a reasonable period, the Client may free of charge contact the consumer mediator to whom HUITIÈME CIEL is affiliated:
